How long should my battery on my nokia N95 be lasting? it seems to last only 1 day and its brand new.?

this is with the bluetooth permenently on but this didnt take that much out my k750 battery

That sounds normal.

Because of the amount of background processing as well as all the other bells and whistles, battery life is sadly the achilles heel in the otherwise wonderful N95.

Try not to have the bluetooth switched on permanently.
